AGREEMENT TO OUR LEGAL TERMS

We are Steill LLC, doing business as Inked (“Inked,” “Company,” “we,” “us,” or “our”). We operate https://inkedofficial.com (the “Site”), along with related products, pages, and services that link to these Terms (collectively, the “Services”). We sell autographed memorabilia and related goods, and we offer pre-orders and send-in signing services.

These Terms form a binding agreement between you and Inked. By accessing or using the Services, you agree you’ve read and accepted these Terms. If you don’t agree, do not use the Services. We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above; your continued use means you accept the revised Terms. The Services are intended for users 18+. If you are under 18, you may not use or register for the Services.

We recommend printing a copy of these Terms for your records.


1) OUR SERVICES

The Services are not intended for use in any jurisdiction where their use would violate local law or require registration we don’t have. If you access from another location, you do so on your own initiative and are responsible for local compliance. The Services are not designed for regulated data (e.g., HIPAA, GLBA).


2) INTELLECTUAL PROPERTY RIGHTS

Our IP. We (or our licensors) own the Site and all content, code, design, images, text, graphics, logos, and trademarks (collectively, the “Content” and “Marks”). They are protected by U.S. and international laws. We provide the Content as-is for personal, non-commercial use only.

Your license. Subject to these Terms, we grant you a limited, revocable, non-transferable license to access the Services and download/print Content you properly access for personal, non-commercial use.

Except as expressly allowed, you may not copy, reproduce, distribute, publicly display, or exploit the Services, Content, or Marks without prior written permission. Requests: Sales@InkedOfficial.com.

Your submissions. If you send us ideas, suggestions, or feedback (“Submissions”), you agree we may use them for any purpose without compensation. You’re responsible for anything you upload or submit and warrant you have rights to do so.


3) USER ACCOUNTS & ACCURACY

You may need an account to purchase or access certain features. Keep your credentials confidential; you’re responsible for activity under your account. We may refuse or reclaim usernames that are inappropriate. You agree to provide accurate, current information and to keep it updated.


4) PRODUCTS & AVAILABILITY

We try to display product details (photos, specs, pricing) accurately, but we can’t guarantee perfect accuracy (monitors differ, stock may change, typos happen). All products are subject to availability and may be limited or discontinued at any time. Prices may change without notice.

Authentication. All autographed items are guaranteed authentic. We use trusted third-party authenticators including Beckett (BAS), JSA, PSA/DNA, Fanatics, SWAU, and ACOA (and similar). Most items (≈99%) include Beckett or JSA certification. Some authenticators are phasing out paper COA cards; in those cases the certification sticker and database record constitute the COA.


5) PURCHASES & PAYMENT

We accept major cards and digital wallets, including Visa, Mastercard, AMEX, Discover, PayPal, Shop Pay, Apple Pay, and Google Pay. Shop Pay Installments may be available (subject to eligibility). All amounts are in USD. Applicable sales tax and shipping are added at checkout.

You authorize us to charge your selected payment method for your order total when you submit an order. We may correct pricing or order errors even after payment is requested/received. We may limit or cancel orders (e.g., suspected resellers, duplicate accounts, or fraud risk).


6) PRE-ORDERS (SIGNING EVENTS)

  • When you place a pre-order, you’re buying an item that will be signed at a future event.

  • We then authenticate the signed item and ship it after completion. Unless you do not purchase the authentication upgrade or request authentication. Then you will receive your item without authentication.

  • Any “delivery estimate” shown at checkout does not apply to pre-orders.

Timelines. Pre-orders generally ship 1–2 weeks after the signing, depending on authenticator turnaround.

Personalization/inscriptions. When available, you may request options such as personalization, character name, quotes, marker color, sketches, etc. Some talent charges additional fees.

Delays/cancellations. Talent schedules can change.

  • If a signing is canceled (by us or the talent), we issue a full refund for that order.

  • If a signing is delayed < 12 months, refunds are not issued due to scheduling realities.

  • If delayed ≥ 12 months, you may request a refund.

All pre-orders are non-refundable once placed, except as noted above or where required by law.


7) SEND-INS (MAIL-INS)

Most signings allow customer send-ins; some talent restrict item types. If unsure, ask before ordering.

Process. (i) Purchase a send-in on the product page; (ii) follow emailed instructions (or our Send-In Instructions page when available); (iii) ship your item with your order number clearly included; (iv) we get it signed, authenticate it, and return it to you.

Packaging. Use a protector (e.g., pop protector/acrylic case/toploader) and place a sticky note on the protector with your order number. If you don’t ship with a protector, we won’t add one for the return.

Risk of loss.

  • Damage/loss to us: you must file the carrier claim; we recommend purchasing insurance commensurate with value (especially >$100).

  • Damage/loss from us back to you: we file the carrier claim.

Extra protection insurance. Optional insurance can be added at checkout. If declined, coverage for loss/damage is capped at $100.


8) SHIPPING & DELIVERY

We ship via common carriers (e.g., USPS/UPS/FedEx). International shipping is available; however, we cannot ship anything resembling a weapon (e.g., swords, blades, knives, prop guns), even if fake.

Handling time. In-stock orders usually ship in 1–3 business days. Orders may be delayed while our team is on the road for signings.

Tracking. Tracking is emailed upon shipment.

Insurance. Optional shipping insurance is available at checkout. If declined, maximum reimbursement for loss/damage is $100. A carrier claim is required before any refund.

Delivered but not received. If tracking shows “delivered” and you didn’t receive the package, we’ll assist with a carrier inquiry/claim, but we are not responsible for replacement or refund except as required by law or applicable insurance coverage.

We ship each order to a single address. We don’t split shipments across multiple addresses.


9) RETURNS & REFUNDS (STORE)

Please review our full Refund Policy (incorporated by reference). Summary:

  • Return window: 14 days from delivery. Items must be untampered, in original condition, and include all COAs/packaging.

  • Pre-orders and private signings: non-refundable once placed (except signing cancellation or as required by law). If a paid inscription isn’t completed, we refund the inscription fee (not the order).

  • Variations in marker color or signature placement are not grounds for refund.

  • Mystery boxes are final sale.

  • Shipping fees are non-refundable.

  • Refunds post after inspection to the original payment method.


10) PROHIBITED ACTIVITIES

You agree not to misuse the Services, including (without limitation): violating laws/regulations; harassing others; attempting unauthorized access; interfering with security or normal operation; scraping; reverse engineering; impersonation; spamming; or using the Services for competitive or commercial purposes not expressly permitted.


11) USER CONTENT (REVIEWS/PHOTOS)

If the Services allow you to submit reviews, photos, or other materials (“Contributions”), you retain ownership but grant us a worldwide, royalty-free, perpetual license to host, display, adapt, and promote them in connection with the Services. You warrant you have the rights to your Contributions, that they don’t infringe others’ rights, and that they comply with these Terms. We may remove or refuse any Contribution at our discretion.


12) PRIVACY

Your use of the Services is also governed by our Privacy Policy (as posted on the Site). The Services are hosted in the United States; by using them from another region, you consent to U.S. transfer/processing.


13) CHANGES, SUSPENSION & TERMINATION

We may modify or discontinue all or part of the Services at any time without notice. We may suspend or terminate access (including blocking IPs) for any violation of these Terms, suspected fraud, risk, or unlawful activity.


14) THIRD-PARTY LINKS & SERVICES

We aren’t responsible for third-party websites, services, or content linked from the Services. Use them at your own risk.


15) DISCLAIMER

THE SERVICES AND ALL CONTENT/PRODUCT INFO ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON’T WARRANT UNINTERRUPTED/ERROR-FREE OPERATION OR COMPLETE ACCURACY OF CONTENT.


16) LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKED (AND OUR OFFICERS/EMPLOYEES/AGENTS) SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/GOODWILL/DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT(S) AT ISSUE, IF ANY. SOME JURISDICTIONS DON’T ALLOW CERTAIN LIMITATIONS; SOME LIMITS MAY NOT APPLY TO YOU.


17) INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Inked and our affiliates, officers, employees, and agents from any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your Contributions, or your breach of these Terms or applicable law.


18) GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of Arizona. The parties consent to exclusive jurisdiction and venue in the state or federal courts located in Maricopa County, Arizona, except as provided in Dispute Resolution below.


19) DISPUTE RESOLUTION; ARBITRATION

If a dispute arises, the parties will first try to resolve it informally. If unresolved, binding arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, the AAA Consumer Rules. The arbitration may be conducted by written submissions, phone, online, or in person in Maricopa County, Arizona. Any claim must be brought within one (1) year after it accrues.

Class action waiver. Arbitration will be conducted on an individual basis; class, consolidated, or representative proceedings are not permitted.

Exceptions. Either party may bring claims in court for injunctive relief or to enforce/intellectual property rights. If arbitration is found unenforceable for a particular dispute, venue shall be as stated in Section 18.


20) ELECTRONIC COMMUNICATIONS & SIGNATURES

By using the Services, sending emails, or submitting forms, you consent to receive electronic communications from us. You agree that electronic agreements, notices, and records satisfy legal requirements that such communications be in writing.


21) MISCELLANEOUS

These Terms (plus any policies referenced, including our Refund Policy and Privacy Policy) constitute the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver. We may assign our rights/obligations; you may not assign without our consent. We aren’t liable for delays beyond our reasonable control.


22) AUCTIONS RUN BY INKED AUCTION

Retail purchases on InkedOfficial.com are governed by these Terms. Auctions conducted on InkedAuction.com are governed by Inked Auction’s own Terms and FAQs. If you participate in an auction, please review:
